1. Agreement
These Terms of Service (“Terms”) govern access to and use of CRMCA websites and the multi-tenant CRM software at https://app.crmca.cc (the “Service”) provided by CRMCA. By creating an account, clicking accept, or using the Service, you agree to these Terms on behalf of the company or organization you represent (“Customer”).
Related documents: Privacy Policy, Cookie Policy, and Data Processing Agreement (DPA) available at https://crmca.cc/legal/.
2. The Service
CRMCA provides cloud CRM and marketing-operations software for businesses and agencies, including modules that may cover clients, projects, tasks, finance tools, leads, SEO/SMM workflows, integrations, and AI-assisted features depending on plan and configuration.
We may modify features to improve the Service, provided we do not materially reduce core contracted functionality without notice where a paid plan applies.
3. Accounts and access
Customer must provide accurate registration information, keep credentials confidential, and ensure only authorized employees or contractors of Customer access the tenant workspace.
Customer is responsible for all activity under its accounts. Notify us promptly of unauthorized use at hello@crmca.cc.
We may suspend access for security incidents, non-payment, or material breach.
4. Customer data and compliance
Customer retains ownership of data it uploads to the Service (“Customer Data”). Customer grants CRMCA a limited license to host, process, transmit, and display Customer Data solely to provide and secure the Service.
Customer is responsible for the lawfulness of Customer Data collection and processing (including notices and consents on Customer websites and lead forms). CRMCA’s processing of personal data in Customer Data is described in the Privacy Policy and DPA.
Customer must not upload unlawful content, special-category data without a lawful basis and appropriate configuration, or data of children.
5. Acceptable use
No reverse engineering except as permitted by law; no probing other tenants’ data; no malware, spam, or abusive automation; no infringement of third-party rights; no use that degrades Service integrity.
6. Third-party services and AI
Optional integrations (Google, Telegram, telephony, LLM providers, etc.) are governed also by those providers’ terms. Customer decides which integrations to enable. AI features may send prompts and context to subprocessors to generate outputs; Customer remains responsible for reviewing AI outputs before relying on them.
7. Content published to third-party platforms
CRMCA provides tools and optional integrations that may allow Customer (the tenant organization) to create, schedule, transmit, or otherwise cause text, media, links, ads, or other materials to be published or submitted to third-party websites, CMS platforms, social networks, advertising platforms, messaging channels, directories, marketplaces, or similar external resources.
Customer remains solely responsible for all such materials and for any publication or submission made through the Service under Customer’s accounts, credentials, or instructions — including content prepared with AI assistance. Customer must ensure it has all rights, licenses, and consents required for that content and for using each third-party platform, and must comply with those platforms’ terms and with applicable law (including advertising, intellectual-property, privacy, and consumer rules).
CRMCA does not control third-party platforms and is not liable for Customer’s content once published or submitted there, for how those platforms display, moderate, or remove it, or for claims arising from Customer’s outbound publishing. Further detail on controller responsibility for Customer Data appears in the Privacy Policy and DPA.
8. Fees
Paid plans are billed according to the order, plan page, or invoice presented in-product. Fees are non-refundable except where required by law or expressly stated. We may change prices with notice for renewal periods.
9. Intellectual property
CRMCA and its licensors own the Service software, branding, and documentation. Customer owns Customer Data. Feedback may be used by CRMCA to improve the Service without obligation.
10. Confidentiality
Each party must protect the other’s confidential information with reasonable care and use it only for performing under these Terms, except for information that is public, independently developed, or required to be disclosed by law.
11. Warranties and disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRMCA DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRMCA’S AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY CUSTOMER TO CRMCA FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. CRMCA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST PROFITS DAMAGES. Some jurisdictions do not allow certain limitations; in those cases liability is limited to the fullest extent permitted.
13. Term and termination
These Terms apply while Customer uses the Service. Either party may terminate for material breach uncured within thirty (30) days after notice. Upon termination, Customer’s access ends; Customer should export Customer Data beforehand where the product allows. We may delete Customer Data after a retention window consistent with the Privacy Policy and DPA, except where law requires longer retention.
14. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules, unless a written order states otherwise. Mandatory consumer protections (if any apply) remain unaffected. Data-protection matters additionally follow applicable GDPR/UK GDPR rules as described in the Privacy Policy and DPA.
15. Changes
We may update these Terms. The version (2026.10.25-v6) will change. Continued use after the effective date constitutes acceptance, except where acceptance of a new version is required in-product.
